1. Agreement to Terms

Welcome to SocialChad! These Terms of Service ("Terms") govern your access to and use of the SocialChad mobile application ("App"), operated by SocialChad ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the modified Terms.

2. Description of Service

SocialChad is a confidence coaching application that provides:

AI-powered analysis of dating profile screenshots to generate conversation openers
An AI chatbot coach ("Chad") for dating and social advice
Progress tracking, achievements, and gamification features
Daily motivation tips and challenges

Important: SocialChad is a self-improvement and confidence-building tool. We do not guarantee any specific dating outcomes, matches, or relationship results. Individual results vary based on usage, effort, and many factors outside our control.

3. Eligibility

To use SocialChad, you must:

Be at least 18 years of age
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the App under applicable laws

By using the App, you represent and warrant that you meet these eligibility requirements.

4. Your Account

You may need to create an account to access certain features. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use Policy

You agree to use SocialChad responsibly and lawfully. You agree NOT to:

Use the App for any illegal purpose or to violate any laws
Upload content that is harmful, offensive, harassing, or violates others' rights
Upload screenshots containing explicit, pornographic, or illegal content
Use the App to harass, stalk, or harm other individuals
Attempt to reverse engineer, hack, or compromise the App's security
Use automated systems or bots to access the App
Impersonate any person or entity
Share your account credentials with others
Use the App to distribute spam or malicious content
Violate the terms of service of any third-party dating platforms

Warning: Violation of these terms may result in immediate account termination without refund.

6. User Content

Your Content

You retain ownership of content you upload to SocialChad (such as screenshots). By uploading content, you grant us a limited license to process, analyze, and store it for the purpose of providing our services.

Content Responsibility

You are solely responsible for the content you upload. You represent that you have the right to share any content you upload and that it does not violate any third-party rights or applicable laws.

Content from Third-Party Platforms

Screenshots from dating apps are subject to those platforms' terms of service. We are not affiliated with any dating platform (Tinder, Hinge, Bumble, etc.). Use of screenshots is at your own risk.

7. AI-Generated Content

SocialChad uses artificial intelligence to generate conversation openers and coaching advice. You understand and agree that:

AI-generated content is provided as suggestions only
You are responsible for how you use any AI-generated content
AI may occasionally produce inaccurate, inappropriate, or unhelpful responses
We do not guarantee the quality, accuracy, or effectiveness of AI responses
You should review and modify AI suggestions before using them

Disclaimer: AI-generated openers and advice are tools to assist you. Always use your own judgment and be authentic in your communications with others.

8. Subscriptions & Payments

Premium Subscription

SocialChad offers premium features through paid subscriptions. Subscription details:

Subscriptions are billed through the Apple App Store
Prices are displayed in the App before purchase
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
You can manage and cancel subscriptions in your App Store account settings

Free Trial

If offered, free trials automatically convert to paid subscriptions unless cancelled before the trial ends. You will be charged the subscription fee upon trial expiration.

Refunds

Payments are processed by Apple. Refund requests must be submitted through Apple's refund process. We do not have direct access to process refunds.

9. Intellectual Property

The SocialChad App, including its design, features, content, and branding, is owned by us and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

Copy, modify, or distribute the App or its content
Reverse engineer or decompile the App
Use our trademarks or branding without permission
Create derivative works based on the App

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties including, but not limited to:

Merchantability and fitness for a particular purpose
Accuracy, reliability, or completeness of content
Uninterrupted or error-free operation
Results or outcomes from using the App

No Guarantees: We do not guarantee any dating success, matches, relationships, or specific outcomes. SocialChad is a tool for self-improvement; results depend entirely on individual effort and circumstances.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIALCHAD SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Any damages arising from your use of or inability to use the App
Any conduct or content of any third party
Any content obtained from the App
Unauthorized access, use, or alteration of your content

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless SocialChad and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Content you upload or share through the App

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Reasons for termination may include:

Violation of these Terms
Illegal or harmful behavior
Extended period of inactivity
Request by law enforcement or government agencies

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if eligible.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration.

15. General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and SocialChad regarding the App.
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
Waiver: Failure to enforce any right does not constitute a waiver of that right.
Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
Notices: We may provide notices through the App or via email to the address associated with your account.
